Pushoney is a hosted, multi-tenant web push notification platform
operated from Casablanca, Morocco. In these Terms,
"Pushoney", "we", "us", or "our" refers to the Pushoney service
and its operators. "You" or "Customer" refers to the individual
or entity that has registered an account at
portal.pushoney.com.
By creating an account, accessing the Service, or sending push notifications through Pushoney, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.
If you are using Pushoney on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
Pushoney provides software to collect, manage, and dispatch web push notifications to subscribers of websites and web applications you operate. The Service is provided free of charge to you, subject to these Terms and to the per-account usage limits we may set from time to time.
Pushoney may, separately and at your option, offer monetisation features that allow you to earn revenue from your subscribers in exchange for permitting Pushoney to dispatch a limited number of promotional notifications to them. Monetisation is opt-in through your account dashboard and governed by additional terms surfaced at the point of opt-in.
You must be at least 16 years old (18 in jurisdictions where
that is the age of contractual majority) to use Pushoney. You
are responsible for keeping your account credentials secure
and for all activity that occurs under your account. Notify us
immediately at [email protected] if you suspect
unauthorised access.
We strongly recommend enabling two-factor authentication on your account.
You agree NOT to use Pushoney to:
We may suspend or terminate any account we reasonably believe has violated this section, with or without notice, and we may cooperate with law-enforcement authorities where required.
You are responsible for obtaining valid, freely-given, informed consent from each subscriber before adding them to your push notification list, in compliance with applicable laws including the EU General Data Protection Regulation (GDPR), the EU ePrivacy Directive, the United Kingdom GDPR, Morocco Law 09-08, the California Consumer Privacy Act (CCPA), and other equivalents.
You must clearly disclose, at the point of subscription, that the subscriber will receive push notifications from your website, what kind of content they will receive, and how to unsubscribe. If you have enabled monetisation on Pushoney, you must additionally disclose that subscribers may receive promotional notifications from Pushoney's partners up to a stated maximum per day. Standard disclosure copy is available in your account dashboard.
You are the data controller for your subscriber data; Pushoney is a data processor acting on your instructions. The division of responsibilities is documented in our standard Data Processing Agreement, available at /legal/dpa.
Pushoney's software, branding, and documentation are owned by us or our licensors. We grant you a non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.
You retain all rights in the content you push through Pushoney. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, and process that content solely for the purpose of operating the Service for you.
The Service is provided on an "as available" basis. We aim for high availability but make no specific uptime commitment in this version of the Terms. Planned maintenance, third-party dependencies (e.g., browser push gateways), and force-majeure events may cause interruptions. We will use reasonable efforts to communicate planned maintenance in advance through the Service or by email.
You may close your account at any time through your account dashboard. We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, for non-use over an extended period, or if we are required to do so by law. Upon termination, we will delete your data in accordance with the retention periods described in our Privacy Policy.
Except where prohibited by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted access.
To the maximum extent permitted by Moroccan law, our total aggregate liability arising out of or related to the Service, whether in contract, tort, or otherwise, shall not exceed one thousand United States dollars (USD 1,000). We will not be liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits, revenue, data, or business opportunity, even if advised of the possibility.
Nothing in this section limits liability that cannot be limited under applicable law, including liability for fraud, wilful misconduct, or personal injury caused by negligence.
You agree to indemnify and hold Pushoney harmless from any claim, loss, or damage (including reasonable legal fees) arising out of (a) your use of the Service in violation of these Terms, (b) your content, (c) your subscribers' claims relating to consent or content you sent through Pushoney, or (d) your violation of any applicable law or third-party right.
We may revise these Terms from time to time. We will notify you of material changes by email or through the account dashboard at least fourteen (14) days before they take effect, except where the change is required for legal or security reasons in which case it may take effect immediately. Your continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the Kingdom of Morocco, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Casablanca, Morocco.
For customers established in the European Economic Area, nothing in this section deprives you of any mandatory consumer-protection right available under your local law.
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a sale of the business or to an affiliate.
